Event Terms, Policies, and Release of Liability

These Event Terms, Policies, and Release of Liability ("Agreement") constitute a legally binding agreement between you ("Participant," "you," or "your") and Coffee and Crystals LLC, a Colorado limited liability company, ("Coffee & Crystals," "we," "us," or "our").
 

By purchasing a ticket, registering for, or attending any Coffee & Crystals event, whether in-person or virtual, free or paid, you affirm that you have read, understood, and agree to be bound by all terms set forth herein.

If you do not agree with any portion of this Agreement, do not register for or attend the event.

 

1. Definitions

"Event" means any in-person or virtual gathering, workshop, circle, retreat, yoga class, mixer, ritual, ceremony, or program hosted, organized, or facilitated by Coffee & Crystals.

"Participant" means any individual who purchases a ticket to, registers for, or attends an Event.

"Facilitator" means Rose, any guest facilitator, instructor, healer, teacher, or third-party practitioner engaged by Coffee & Crystals to lead or contribute to an Event.

"Venue" means any location, virtual platform, or property where an Event is held.

 

2. Tickets, Registration, and Payment

2.1 Payment. All ticket prices are listed in U.S. Dollars. Payment is required at the time of registration. Your registration is not confirmed until payment is received in full.

2.2 All Sales Final. ALL TICKET SALES ARE FINAL AND NON-REFUNDABLE. Coffee & Crystals does not provide refunds for any reason, including but not limited to: personal illness, work conflicts, scheduling conflicts, transportation issues, change of mind, dissatisfaction with the Event, weather-related personal travel decisions, or failure to attend.

2.3 Transfer of Tickets. Tickets may be transferred to another individual at no cost, subject to the following conditions: (a) You must provide written notice to hello@coffeeandcrystals.com at least twenty-four (24) hours before the Event start time; (b) Notice must include the original ticket holder's name and the full legal name and email address of the new attendee; (c) The new attendee must agree to and be bound by these Terms upon attendance; (d) Transfers requested less than twenty-four (24) hours before the Event will be accommodated at Coffee & Crystals' sole discretion.

2.4 Right to Refuse Service. Coffee & Crystals reserves the absolute right to refuse entry to, remove from, or decline future registrations from any Participant whose conduct, in our sole discretion, threatens the safety, well-being, or experience of other Participants, Facilitators, or staff. No refund or credit will be issued in such cases.

2.5 Identification. We may require photo identification at check-in to verify ticket holders.

 

3. Event Cancellation, Postponement, and Modification

3.1 Cancellation by Coffee & Crystals. If Coffee & Crystals cancels an Event in its entirety and does not offer a rescheduled date, Participants will receive, at our sole discretion, either: (a) A full refund of the ticket price paid (excluding any non-refundable processing fees retained by third-party payment processors); or (b) A credit of equivalent value applied toward a future Coffee & Crystals Event.

3.2 Rescheduling. If an Event is postponed or rescheduled, all tickets automatically transfer to the new date. If you are unable to attend the rescheduled date, you may: (a) Transfer your ticket to another individual per Section 2.3; or (b) Request a credit of equivalent value toward a future Event by emailing hello@coffeeandcrystals.com within seven (7) days of the reschedule notice.

3.3 Modification of Event Content. Coffee & Crystals reserves the right to substitute Facilitators, modify Event content, change Venue, or adjust Event timing for any reason. Such modifications do not entitle Participants to a refund.

3.4 Force Majeure. Coffee & Crystals shall not be liable for any cancellation, delay, modification, or failure to perform resulting from events outside our reasonable control, including but not limited to: acts of God, severe weather, natural disasters, pandemics, government restrictions, public health emergencies, civil unrest, acts of war or terrorism, fire, flood, power outages, facility closures, or other emergencies. In such circumstances, the cancellation and rescheduling terms in Sections 3.1 and 3.2 shall apply.

 

4. Weather Policy

4.1 Outdoor Events. Events scheduled outdoors will proceed in light rain, mild wind, or cool temperatures. Participants should dress and prepare accordingly.

4.2 Severe Weather. In the event of severe weather conditions or public safety advisories that, in our sole discretion, present a risk to Participant safety, Coffee & Crystals may: (a) Move the Event indoors; (b) Reschedule the Event; or (c) Cancel the Event per Section 3.1.

Participants will be notified by email or text message of any weather-related changes as soon as reasonably possible.

 

5. Assumption of Liability 

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

5.1 Nature of Activities. Coffee & Crystals Events may include, without limitation: physical movement, yoga, breathwork, meditation, ritual practices involving open flame, candles, incense, herbs, essential oils, crystals, water, sound, music, group discussion, energetic healing modalities (including but not limited to Reiki, EFT tapping, sound healing), guided visualization, and emotional processing.

5.2 Acknowledgment of Risk. You acknowledge and understand that participation in these activities involves inherent risks, including but not limited to: (a) Physical injury, illness, or aggravation of pre-existing conditions; (b) Emotional or psychological distress, including the surfacing of difficult memories, emotions, or sensations; (c) Allergic or adverse reactions to herbs, oils, smoke, candles, foods, or environmental factors; (d) Burns or injury from open flame, candles, or heated objects; (e) Slips, falls, sprains, or other injuries during movement-based practices; (f) Property damage, theft, or loss of personal belongings; (g) Exposure to communicable illness; (h) Travel-related risks to and from the Venue.

5.3 Voluntary Participation. You confirm that: (a) Your participation in any Event activity is entirely voluntary; (b) You may decline to participate in any individual activity without penalty; (c) You have considered any medical, mental health, physical, or allergy conditions that may affect your participation; (d) You will inform Coffee & Crystals in advance of any condition requiring accommodation; (e) You are not under the influence of alcohol or any substance that would impair your safety or that of other Participants.

5.4 Medical Conditions and Accommodations. Pregnant individuals, individuals recovering from injury or surgery, individuals with cardiovascular, respiratory, neurological, or psychiatric conditions, and individuals with allergies to herbs, oils, or other natural materials must notify Coffee & Crystals at hello@coffeeandcrystals.com prior to the Event to discuss safe participation.

5.5 Not Medical, Psychological, or Therapeutic Advice. Coffee & Crystals, its Facilitators, and its Events do not provide medical, psychiatric, psychological, or licensed therapeutic services. Information shared during Events is for educational, spiritual, and personal exploration purposes only. Nothing offered at an Event is a substitute for licensed medical, mental health, or therapeutic care. You agree to consult appropriate licensed professionals for any medical or mental health concerns.

5.6 RELEASE AND WAIVER. IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE IN A COFFEE & CRYSTALS EVENT, YOU, ON BEHALF OF YOURSELF, YOUR HEIRS, ASSIGNS, PERSONAL REPRESENTATIVES, AND NEXT OF KIN, HEREBY:

(a) RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Coffee & Crystals, its owners, members, officers, employees, contractors, Facilitators, agents, and Venue hosts (collectively, "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, illness, or death that may be sustained by you while participating in, traveling to or from, or in any way associated with a Coffee & Crystals Event;

(b) AGREE TO INDEMNIFY AND HOLD HARMLESS the Released Parties from any loss, liability, damage, or costs they may incur due to your participation, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASED PARTIES OR OTHERWISE;

(c) ASSUME FULL RESPONSIBILITY for any risk of bodily injury, death, or property damage arising from your participation.

5.7 Severability. If any provision of this release is held to be unenforceable, the remaining provisions shall continue in full force and effect.

 

6. Photography, Recording, and Intellectual Property

6.1 Consent to Photography and Recording. By attending an Event, you grant Coffee & Crystals the irrevocable, perpetual, worldwide, royalty-free right to photograph, film, audio record, and otherwise capture your image, likeness, voice, and statements, and to use such recordings in any medium, including but not limited to: websites, social media, marketing materials, newsletters, courses, books, podcasts, and any commercial or promotional purpose, without compensation to you.

6.2 Opt-Out. If you do not wish to appear in photographs or video, you must notify Coffee & Crystals upon arrival at the Event. We will make reasonable efforts to exclude you from individual photographs, but we cannot guarantee complete exclusion from group shots, wide-angle footage, or candid imagery.

6.3 Participant Recording Restrictions. Participants may not: (a) Photograph or record other Participants without their explicit consent; (b) Record full Event content, Facilitator teachings, rituals, meditations, or workshop materials without prior written permission from Coffee & Crystals; (c) Reproduce, distribute, or share any Event content, Facilitator teachings, or intellectual property without prior written permission.

6.4 Intellectual Property. All content created or shared by Coffee & Crystals and its Facilitators — including but not limited to ritual scripts, meditation recordings, teachings, written materials, digital products, and Event programming — is the intellectual property of Coffee & Crystals or the respective Facilitator. Unauthorized reproduction, redistribution, or commercial use is prohibited.

 

7. Confidentiality and Code of Conduct

7.1 Confidentiality. Coffee & Crystals Events are sacred spaces. Personal stories, vulnerabilities, identities, and experiences shared by other Participants during an Event are confidential. You agree not to disclose, repeat, post, screenshot, or otherwise share other Participants' personal disclosures outside of the Event.

7.2 Code of Conduct. All Participants agree to: (a) Treat all Participants, Facilitators, and staff with respect; (b) Refrain from harassment, discrimination, hate speech, or unwelcome physical contact; (c) Refrain from offering unsolicited medical, psychological, or spiritual advice to other Participants; (d) Refrain from soliciting, marketing, or promoting outside services or products to other Participants without prior approval; (e) Refrain from disruptive, intoxicated, or unsafe behavior.

7.3 Violation of Code of Conduct. Violations of this Code of Conduct may result in immediate removal from the Event without refund, exclusion from future Events, and where applicable, reporting to local authorities.

 

8. Personal Property

Coffee & Crystals is not responsible for any loss, theft, or damage to personal property brought to an Event. Participants are responsible for their own belongings at all times.

 

9. Communications

9.1 Event Communications. Upon registration, you will receive: a confirmation email, reminder emails before the Event, and a follow-up email after the Event. These communications are necessary to fulfill your registration and cannot be opted out of for registered Events.

9.2 Marketing Communications. You will be added to the Coffee & Crystals general email list and may receive marketing communications. You may unsubscribe at any time via the link provided in any marketing email.

9.3 SMS/Text Messages. Coffee & Crystals may send urgent Event updates via SMS if you have provided a mobile phone number. Standard messaging rates apply.

 

10. Governing Law and Dispute Resolution

10.1 Governing Law. This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of laws principles.

10.2 Venue. Any legal action arising out of or relating to this Agreement or any Event shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to the personal jurisdiction of such courts.

10.3 Informal Resolution. Before initiating any legal action, you agree to first contact Coffee & Crystals at hello@coffeeandcrystals.com and attempt to resolve the dispute in good faith for a period of at least thirty (30) days.

10.4 Class Action Waiver. You agree that any claim or dispute shall be brought solely in your individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

 

11. Miscellaneous

11.1 Entire Agreement. This Agreement constitutes the entire agreement between you and Coffee & Crystals regarding Event participation and supersedes all prior agreements.

11.2 Modification. Coffee & Crystals reserves the right to modify this Agreement at any time. The version in effect on the date of your registration governs your participation.

11.3 Severability. If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force.

11.4 No Waiver. Coffee & Crystals' failure to enforce any provision of this Agreement does not waive its right to enforce that provision in the future.

11.5 Assignment. You may not assign your rights or obligations under this Agreement. Coffee & Crystals may assign this Agreement at its discretion.

 

12. Acknowledgment

BY PURCHASING A TICKET, REGISTERING FOR, OR ATTENDING ANY COFFEE & CRYSTALS EVENT, YOU ACKNOWLEDGE THAT:

• You are at least eighteen (18) years of age, or if attending with a minor, you are the parent or legal guardian of that minor and accept responsibility for them;

• You have read, understood, and voluntarily agree to all terms set forth in this Agreement;

• You have had an opportunity to ask questions about this Agreement;

• You understand that you are giving up substantial legal rights, including the right to sue;

• You sign this Agreement freely, knowingly, and voluntarily.
